EDD members win arbitration on scheduling PLP time

Arbitrator rules management violated side letter on "maximum discretion" for scheduling employee time off


Local 1000 members in the Employment Development Department (EDD) won a favorable arbitration ruling against the state after their department excessively restricted the ability of members to use their PLP 2012 time.

"This arbitration victory shows that we can successfully stand up to management when they are unreason- able," said Joyce Wheeler-Owens, an EDD employee in San Diego. "We have put management on notice that we will not back down on contract violations."

Highlights of Ratified Side Letter Agreement

PLP 2012

1. Each full-time employee's monthly pay shall be reduced by 4.62 percent.

  • This reduction shall not affect transfer determinations between state civil service classifications.
  • Compensation for purposes of retirement, death, and disability benefits shall not be affected by this reduction and shall be based on the unchanged salary rate.
  • Service calculation for purposes of retirement allowances shall be based on the amount of service that would have been credited based on the unchanged salary rate.
  • Part-time employees shall be subject to the pay reduction on a pro-rated basis consistent with their time-base.

PDD and PLP Days - Use them or lose them

June 30 deadline: Time is running out to use the PDD days we earned during this fiscal year

Professional Development Days

All employees accumulate two Professional Development Days during each fiscal year (July 1 - June 30), and those days must be used during that same fiscal year. PPD days are to be used at the employee's discretion, and management may not request any documentation.

Read state's order ending SEIU, exempt workers' unpaid leave (Sacramento Bee)

November is the first pay period that exempt employees and workers covered by SEIU Local 1000 return to full hours and pay (which will show up on the Dec. 1 paycheck.)

We're still receiving a trickle of email and phone calls from employees who either haven't heard or don't believe it. So we're posting the highly technical proof: the Nov. 1 pay letter from the Department of Personnel Administration to the State Controller's Office. The key sentence:

The State Controller's Office will process an employment history mass update to delete the Personal Leave Program (PLP) ... for rank-and-file employees in bargaining units 1, 3, 4, 11, 14, 15, 17, 20, and 21, as well as excluded, exempt, and statutory employees.

DJJ calendar


The academic calendar for teachers in the Division of Juvenile Justice (DJJ) was signed by Unit 3 negotiators on Jan. 25. The academic year starts Aug. 1, 2011, and ends July 6, 2012. The beginning of the 2012-13 academic year will be discussed over the following months and be announced no later than Nov. 15, 2011. Until discussions are held, it will remain unknown whether July 30-31, 2012, will be work days (this is reflected on the calendar).

Note: No Personal Leave Program 2010 (PLP) blackout days were proposed by the Education Service Branch of DJJ. The management team reaffirmed its commitment that DJJ teachers should be afforded maximum discretion in the use of furlough and PLP 2010 leave in consideration for pay cuts experienced as a result of both programs.

Frequently asked questions about your new union contract

Your questions answeredQ. How do we accrue days under the new Personal Leave Program (PLP)?

A. All employees will accumulate one personal leave day (eight hours) per month for 12 months (Nov. 2010 - Oct. 2011). In exchange, employee pay will be reduced by 4.62 percent for the same 12-month period, reflected on your paychecks from Dec. 1, 2010 through Nov. 1, 2011.

Employees can bank this time as long it is all used by June 30, 2013. This PLP leave must be used prior to the use of vacation, annual leave and any other leaves (except sick leave).

You will receive eight hours of PLP per month, for 12 months. Our first credit will be for this month (November).

Subsequent credits will be added to our accounts on the first of each month through Oct. 1, 2011.
